The Site hosts a webstore of products equipped with payment and transactional functions enabling Members and unregistered users to purchase available inventory. We attempt to be as accurate as possible when listing product and manufacturer information, however, we do not warrant that the information is error-free. We reserve the right to deny any sale due to website errors.

 

Live Chat

 

The Site features live chat and instant messaging capabilities (“Live Chat”) when available. The Live Chat is equipped with live messaging facilities enabling Members and unregistered users to communicate directly with Victory Mobility & Repairs. You are solely responsible for the activity that occurs on your Member Account, and for keeping your Member Account password secure. If you provide any information that is untrue, inaccurate, not current, or incomplete, or if we or any of our authorized agents have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse your current or future use of the Service, as well as possibly subjecting you to criminal and civil liability.

You agree to (A) immediately notify us of any unauthorized use of your Member Account or any other breach of security, and (B) ensure that you exit from your account at the end of each session. You are liable and responsible for any unauthorized use of the Service through your Member Account. Unauthorized access to the Service is illegal and a breach of this Agreement. You agree to indemnify us against all activities conducted through your Member Account.

 

Placing an Order

 

To place an order through the Website, you must provide us with all the required information. This may include, without limitation, your full name, shipping and billing address, date of birth, or payment information including but not limited to your credit card number, card verification number, and expiration date. Purchases may be executed via Wix Pay, or other third-party payment service providers that we may make available for your use. We are not responsible or liable for any activities or conduct of Wix Pay or other third-party service providers, and you agree to hold us harmless and expressly release us from any and all liability arising from or in connection with any products that are offered for sale via the Site. We reserve the right to deny any sales due to Site errors. In the event of a denied sale due to a Site error, you will be notified by phone or email and will receive a refund in full.

 

Delivery

 

Orders are usually shipped within 1 to 3 business days from the date of order. Your order may be subject to government inspection, shipping delays, strikes, and other unforeseeable events, we, therefore, do not guarantee a specific delivery date, rather we provide you with an estimated date. Orders are shipped either to Victory Mobility & Repairs or to the address provided at the time you place the order. We reserve the right to offer you an option for expedited shipping at an additional cost. Please note that additional local taxes may be applied.

The majority of items are shipped via FedEx Ground or UPS. Victory Mobility & Repairs reserves the right to utilize specialized freight carriers that may be used for larger items.

The risk of loss and title for all products you order passes to you upon our delivery to the carrier.

 

Payments and Transactions

 

We use third-party payment platforms including but limited to, Wix Payments, to process credit and debit card transactions for your orders. You expressly understand and agree that we shall not be liable for any payments and monetary transactions that occur through your use of the Site. You expressly understand and agree that all payments and monetary transactions are handled by third parties. You agree that we shall not be liable for any issues regarding financial and monetary transactions between you and any other party. You are responsible for all transactions (one-time, recurring, and refunds) processed through the Site and/or third parties. We are not liable for loss or damage from errant or invalid transactions processed due to a network communication error, or any other reason. If you process a transaction, it is your responsibility to verify that the transaction was successfully processed. You must not process stolen credit cards or unauthorized credit cards through the Site.

 

Cancellation/Refund Policy

 

Return Process

​

We want you to be completely satisfied with every item you purchase. If you are not completely satisfied, you can return most items within 15 days. The 15 days are consecutive calendar days and they begin the day you receive the product. Please inspect your product upon delivery. If the product is damaged or is not the correct product, please refuse the delivery. Once delivery has been accepted, the following conditions apply:

 

All items have a Restocking Fee

​

• You are responsible for the cost of return shipping and the product must be in the original packaging, complete with tags, instructions, and inserts.

• The item must be in new, unused condition. Indications of use include, but are not limited to: cracks, scratches, dirty tires, pet hair or other household dirt, wear to seats and armrests, damage to charging ports, scratches to the frame or scratches to remotes.

• All accessories and chargers included in the product's box must be returned. 

• Ex. chargers, baskets, additional colored shrouds. 

• Accessories not included in the box, those purchased separately, do not have to be returned as part of a power chair/scooter return.

• Unfortunately, outgoing freight, delivery service fees, including Next-Day and Overnight shipping fees, Inside Delivery, and Tech Set-Up are not refundable.

• Contact Victory Mobility & Repairs to obtain an RA number, within the product’s return window

• To obtain an RA number contact us at 813-768-4777 or email at victorymobility@gmail.com. Please include your order number, name, and the item you are returning.

• Most items can be returned. All returned items are subject to a 25% restocking fee and actual costs associated with shipping the product both to the customer and the return shipment to Victory Mobility & Repairs.

 

Canceled Orders

​

Orders canceled after the item has shipped are subject to all standard return policies. You must accept delivery, obtain an RA Number and ship the item back to the correct address. If delivery of an item is refused, return shipping costs are deducted from the issued credit and a 25% restocking fee (minimum $25) will apply. Second-Day and Next-Day shipping costs will not be credited if delivery is refused.

Non-Returnable Items:

Any item that has customized fabric, paint, dimensions, or accessories specific for Customer may not be returned

 

Product Warranties

 

We warranty all used power chairs and scooters for 30 days from delivery that do not function according to the manufacturer’s specifications. If there is a problem with a chair, you must first contact Victory Mobility & Repairs through email at victorymobility@gmail.com. 

The warranty is void if the chair is damaged due to misuse, accident, or if the chair is used in any way that would not be covered under the terms listed in the manufacturer's original warranty. 

 

Monitoring and Removal of Content

 

We reserve the right but have no obligation, to monitor any and all public postings, messages, or other content on the Service. We also reserve the right but have no obligation, to monitor any and all messages and chats that take place through the Service. Notwithstanding our right to monitor content, we are not responsible for any offensive or obscene material(s) that may be transmitted or posted by any and all members (including unauthorized members, as well as the possibility of “hackers”).

 

Due to the volume of content on the Service, we do not and cannot review every message, content, or other information posted or sent through the Service. We are not responsible for any content of these messages or materials. We reserve the right but are not obligated, to delete, move, or edit messages or materials, including without limitation advertisements, public or private postings, and messages, that we, in our sole discretion, may deem to violate these terms and conditions or to be otherwise unacceptable to us in our sole discretion. Notwithstanding our right to delete, move or edit messages or materials, you shall remain solely responsible for the content of advertisements, public postings, messages, and other materials you may upload to the Service or otherwise provide to members of the Service.

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions: or any provisions hereof: whether in contract tort: or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act: conducted by a single neutral arbitrator and administered by the

American Arbitration Association: or a similar arbitration service selected by the parties: in a location mutually agreed upon by the parties. The arbitrator's award shall be final: and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action: proceeding or arbitration arises out of or concerns these Terms and Conditions: the prevailing party shall be entitled to recover its costs and reasonable attorneys fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions: whether directly or indirectly: including Tort claims that are a result of these Terms and Conditions. The

parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute: including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
 

Class Action Waiver

 

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representatiæ'collective actions are not permitted. Further, unless both you and Mobility & Repairs agree otherwise, the arbitrator may not consolidate more than one person's claims: and may not otherwise preside over any form of a representative or class proceeding.
